Man Arrested for Burglarizing Same Residence – Twice

CROCKETT – A Crockett man was charged with burglary of a habitation after two witnesses alleged he and another man had burglarized a residence located on County Road 2165.

Kenneth Burton, Jr., 31, who had previously been arrested for burglarizing the same residence on Nov. 24 was wanted in connection with two previous burglaries of the CR 2165 residence. The first was alleged to have occurred on Nov. 10 and involved the theft of two mattresses.

The second burglary allegedly occurred on Nov. 17 and involved the theft of a china cabinet, dishes, couches, other furniture and various other household items.

According to a probable cause affidavit, two witnesses to the Nov. 10 crime were interviewed on Nov. 27.

“Both of the witnesses identified Kenneth Burton, Jr. and (another suspect) as the persons doing the burglary,” the affidavit stated.

During the interview, the witnesses indicated Burton and the other suspect asked if the witnesses could give them a ride to the CR 2165 location in order to haul two beds back to town. Burton’s vehicle was too small and would not hold the beds, the report stated.

“When they arrived at the property, Kenneth Burton, Jr. and (the other suspect) climbed over the gate on the property, brought two beds from the residence and loaded them on the truck provided by one of the witnesses,” according to the affidavit.

Burton allegedly told the witnesses the beds were his and he needed to remove them “… before the deer hunters got there. He promised one of the beds to the driver of the truck for being able to use the truck to haul the beds out.”

Burton was served with a second arrest warrant for burglary of this habitation, a second degree felony.

According to Section 12.33 of the Texas Penal Code, “An individual adjudged guilty of a felony of the second degree shall be punished by imprisonment in the institutional division for any term of not more than 20 years or less than two years. In addition to imprisonment, an individual adjudged guilty of a felony of the second degree may be punished by a fine not to exceed $10,000.”
