Inmate Sexually Assaulted in Houston County Jail

HOUSTON COUNTY – A convicted felon, housed at the Houston County Jail while he awaits trial on an unrelated crime, has been charged with sexually assaulting a 19-year-old male inmate.

According to an arrest report, Robert David Mobley, Jr., 41, sexually assaulted the victim/inmate in the shower area of Cubicle C-1 – located in the Houston County Jail – on the night of Jan. 27 between the hours of 10:30 and 11 p.m.

The report indicated while the victim/inmate was in the shower, he was grabbed by Mobley and sexually assaulted.

During the assault, Mobley stated to (the victim/inmate) “… I’m gonna show you what it feels like,’” the report alleged.

In addition, while the assault was occurring, the legal document indicated one of the other nine inmates housed in Cubicle C-1 “… rose up from his bunk and asked both, ‘Is everything good?’ Mobley, who had now worked his way over to the toilet said ‘yeah’ to the comment and then eyed the victim/inmate in a threatening manner.”

The victim/inmate also answered in the affirmative “… out of fear of retaliation and/or violence towards him and believed that the actor/inmate has the ability to execute the threat,” the report stated.

The report further indicated the sexual assault was ended when the victim/inmate was able to grab Mobley in the groin region.

“The victim/inmate was then transported to Harold’s House on Jan. 30 to have a sexual assault examination performed,” the report further indicated.

Once the examination had been completed, the SANE nurse informed investigators “… that the injuries are consistent with that of sexual assault,” according to the report.

As a result of the findings an arrest warrant was issued for Mobley for the offense of sexual assault as described in Section 22.011 of the Texas Penal Code and the offense is considered a second degree felony.

According to Section 12.33 of the Texas Penal Code, “An individual adjudged guilty of a felony of the second degree shall be punished by imprisonment in the institutional division for any term of not more than 20 years or less than two years. In addition to imprisonment, an individual adjudged guilty of a felony of the second degree may be punished by a fine not to exceed $10,000.”

Mobley is held at the Houston County Jail and has been “no-bonded.”
